Diese Bedingungen gelten auch für alle künftigen Produktions- und Lizenzverträge, sofern nicht ausdrücklich abweichende Regelungen vereinbart werden. Diese AGB gelten ab 01.11.2021. Kostenerhöhungen braucht der Fotograf nur anzuzeigen, wenn eine Überschreitung der ursprünglich veranschlagten Gesamtkosten um mehr als 15 % zu erwarten ist. 2.2 Bevollmächtigung zur Beauftragung Dritter Muss bei der Auftragsabwicklung die Leistung eines Dritten in Anspruch genommen oder ein sonstiger Vertrag mit Dritten abgeschlossen werden, ist der Fotograf bevollmächtigt, die entsprechenden Verpflichtungen im Namen und für Rechnung des Auftraggebers einzugehen. 2.3 Briefing Das Briefing des Auftraggebers bildet die Grundlage für die vom Fotografen zu erstellenden Aufnahmen und Kalkulationen. Das Briefing hat der Auftraggeber vollständig, abschließend und schriftlich (z. B. als schriftliches Protokoll einer Besprechung, per E-Mail etc.) an den Fotografen zu erteilen. Für den Fall, dass der Auftraggeber dem Fotografen kein schriftliches Briefing erteilt, bilden das Pre-Production-Meeting (PPM), der bisherige E-Mail-Verkehr zwischen dem Auftraggeber und dem Fotografen sowie die vom Fotografen angefertigten Gedächtnisproto- kolle zum PPM und Telefonnotizen die Grundlage für die Anfertigung der Aufnahmen. 2.4 Künstlerischer Gestaltungsspielraum Bei der Anfertigung der Aufnahmen besteht für den Fotografen künstlerische Gestaltungsfreiheit, wobei jedoch die verbindlichen Vorgaben des Auftraggebers aus Briefing, PPM und/oder mündlichen bzw. telefonischen Anweisungen zu beachten sind. Reklamationen und/oder Mängelrügen hinsichtlich des vom Fotografen ausgeübten künstlerischen Gestaltungsspielraums sind ausgeschlossen. Nachträgliche Änderungswünsche des Auftraggebers bedürfen einer gesonderten Vereinbarung und sind gesondert zu vergüten. 2.5 Mängelrügen Ist der Auftraggeber selbst oder ein von ihm Bevollmächtigter bei der Produktion der Aufnahmen anwesend, hat dieser die Aufnahmen noch am Set/beim Shooting zu untersuchen und eventuelle Mängel gegenüber dem Fotografen unverzüglich zu rügen, damit der Fotograf den Mangel beseitigen und neue Aufnahmen erstellen kann.
